China Customs IP recordal puts eligible rights and identification information on file with the General Administration of Customs of China (GACC). For a foreign brand, useful preparation connects the China-protected right, its owner, a China-based filing contact, and reliable information about genuine and suspected infringing goods. Recordal does not create a trademark, copyright or patent, and it does not automatically stop shipments.

This guide concerns IP protection relating to imports and exports of goods. It is not a substitute for registering or maintaining the underlying right, nor a guide to resolving every online or domestic infringement. Official sources were checked on October 19, 2026.

Confirm the right and the owner before assembling a file

Article 2 of the Regulations on Customs Protection of Intellectual Property Rights covers trademark rights, copyright and related rights, and patent rights protected under Chinese law and relating to imported or exported goods. A U.S.-only trademark registration is not a substitute for a right protected in China. Copyright eligibility and evidence require their own analysis; do not assume that every type of IP needs the same registration certificate.

Start with the actual right number, protected subject matter, current owner and legal status. Reconcile company-name variations, assignments and renewals with the official record before filing. A distributor's commercial role or a supplier's possession of product drawings does not, by itself, establish that it owns the right being recorded.

Put the foreign owner's authority and contact arrangements in place

Article 2 of the Customs implementing measures requires an overseas rights holder to apply through its office established in China or an entrusted agent in China. An entrusted agent needs the prescribed power of attorney. The appropriate applicant remains the rights holder; appointing an agent does not transfer ownership.

Agree on who may submit the application, answer a request for clarification, update the record and approve action when Customs reports a shipment. Check the agent's authority and contact details against the chosen workflow. These arrangements should be explicit rather than assumed from an unrelated distribution or manufacturing contract.

Prepare evidence for the particular right

Articles 6 and 7 of the implementing measures distinguish the application information from its supporting documents. Use GACC's official recordal service guide to check the current filing process and the materials relevant to the transaction. The combined catalogue covers several rights and procedures; it should not be read as requiring every listed document for every application.

A practical preparation file should bring together:

  1. The rights holder's identity documents and the agent's authority, where applicable.

  2. Evidence of the specific China-protected right and any relevant assignment, change or renewal records.

  3. The applicable licensing information, including the licensee, scope and duration, supported by the required documents or explanation.

  4. Photographs of legitimate goods and packaging, with accurate product and trade information.

  5. Known evidence about suspected infringing imports or exports and any relevant existing court or administrative documents.

The right-specific requirements matter. For copyright that has not been voluntarily registered, Article 7 permits work samples and other evidence establishing the applicant's ownership; do not convert this into a universal prior-registration requirement. Patent supporting documents vary with the patent type and circumstances. Have the filing agent check the applicable evidence rather than treating a trademark certificate as a model for every right.

Foreign-language documents and evidence require Chinese translations under Article 7. Notarization or authentication may be required when GACC considers it necessary; the rule does not say that every document must automatically undergo both. Resolve document requirements before arranging unnecessary certification work.

Make genuine trade recognizable without making unsupported accusations

The Regulations ask for information about licensed use, legitimate goods and known infringing goods. Turn that information into a usable identification file: dated product photographs, packaging versions, the relevant mark or work, license scope and known trading parties. Keep a clear source and date for any shipment intelligence.

For example, a brand may have an approved factory and a separately authorized exporter. Recording only the factory while leaving the licensing and exporter information unexplained can make a later shipment harder to assess. This is a hypothetical coordination issue, not a conclusion that a particular shipment infringes.

Treat an unfamiliar exporter as a reason to investigate, not automatic proof of counterfeiting. Distinguish what is established by a right or authorization document from what is suspected. Recordal information should help Customs assess goods, not become an unsupported blacklist of commercial counterparties.

Plan for notices and maintenance after approval

Recordal is particularly relevant to the Customs-initiated route concerning recorded rights. Under Article 16 of the Regulations, after a written notice is served, the rights holder has three working days to submit the required detention application and provide the required security. Recordal alone does not satisfy those steps. A missed response or absent security can prevent detention under that route.

Before filing, identify a decision-maker, a China contact and a person responsible for arranging security and related costs. Keep them reachable during the relevant Chinese working days. Confirm the notice, legal route and actual deadline immediately if a shipment is reported; do not wait for a routine overseas approval meeting. Detention is also distinct from a final infringement finding or confiscation.

The recordal generally lasts ten years from approval, limited by the remaining validity of the underlying right. Where the right remains valid, renewal can be requested within the six months before recordal expiry. Articles 11 and 12 of the implementing measures also require action within 30 working days for relevant information changes, and cancellation following loss of protection or an effective transfer. An assignment therefore needs more than silently replacing a contact name on the old owner's file. Ask the agent to distinguish a change from cancellation and the new owner's filing.

Questions foreign brands often ask

Is recordal mandatory for every Customs protection request?

No. The Regulations permit recordal, while Article 14 of the implementing measures expressly addresses detention applications involving unrecorded rights, with additional supporting evidence. This does not make recordal irrelevant: the Customs-initiated notification route described above concerns recorded rights.

Does an approved recordal guarantee that infringing exports will be stopped?

No. It is an information and protection mechanism, not a promise that every shipment will be detected or detained. Identification evidence, timely applications, security and the applicable procedure still matter. Detention does not itself decide every infringement question.

What should an initial inquiry contain?

Start with public right numbers, the product category, whether there is an actual shipment concern, the China-specific objective, timing and budget. Agree on conflict checks, confidentiality and a secure channel before sharing confidential supply-chain files or unpublished technical material.
